EMS Consulting (Engineering Manpower Solution) (“we”, “us”, or “our”) is committed to protecting your privacy. This policy explains what personal data we collect, why we collect it, how we store and protect it, who we share it with, and the rights available to you under India's Digital Personal Data Protection Act, 2023 (the “DPDP Act”) and applicable rules.
By submitting your information through our website (for example, the Submit Resume, Post a Requirement, or Contact forms), you consent to the processing of your personal data as described in this policy.
1. Data we collect
Depending on how you interact with us, we may collect:
Candidates (job seekers)
- Identity & contact details — name, gender, email, mobile number, city, state, country.
- Professional details — education, work experience, current salary (if you choose to share it), key skills.
- Your CV / resume document and the information it contains.
Employers
- Company name and contact person details (name, email, phone).
- Hiring requirement details — role, location, experience, budget, and job description.
General enquiries
- Name, email, phone (optional), and the contents of your message.
Technical data
- Limited, privacy-friendly usage statistics, measured by our own website (no third-party analytics): the pages you view and for how long, the website or search engine that sent you, approximate location (city level, worked out from your internet connection; we do not store your IP address), device and browser type, page loading speed, and actions such as searching our jobs or tapping the WhatsApp or call button.
- A random identifier kept in your browser's local storage (and a matching first-party cookie), so a return visit is not counted as a new visitor and a submitted form can be linked to the visit it came from. It contains no personal information.
- These statistics are kept for up to 25 months and used only to operate and improve the site. We do not use them to build advertising profiles or share them with anyone.
2. Why we use your data (purpose)
- To match candidates with relevant job opportunities and to assess suitability for roles.
- To respond to employer requirements and source suitable candidates.
- To respond to your enquiries and provide our recruitment services.
- To contact you about your application, a requirement, or an enquiry.
- To comply with legal obligations and maintain records.
We process your data on the basis of the consent you provide when submitting a form, and for the legitimate purpose of providing the recruitment services you have requested.
3. How we share your data
- With employers / clients: candidate profiles and CVs are shared with prospective employers only where relevant to a role, to facilitate placement.
- With service providers (data processors): we use trusted infrastructure providers to host the website and store data securely on our behalf, bound by confidentiality and data-protection obligations.
- Legal: where required by law, regulation, or a valid legal request.
We do not sell your personal data to any third party.
4. Storage & security
- Data is transmitted over encrypted (HTTPS/TLS) connections.
- Uploaded CVs are stored in a private storage bucket that is not publicly accessible; they can be retrieved only by our authorised recruitment team through an authenticated admin area.
- Lead and submission records are protected by access controls (row-level security) so they are not publicly readable.
- We apply reasonable technical and organisational safeguards appropriate to the sensitivity of the data.
5. Data retention
We retain candidate and employer data for as long as necessary to provide our recruitment services and to consider you for current and future opportunities, and thereafter only as required for legitimate business or legal purposes. You may request deletion of your data at any time (see your rights below), after which we will erase it unless retention is legally required.
6. Your rights under the DPDP Act
As a Data Principal, you have the right to:
- Access a summary of the personal data we hold about you and how it is processed.
- Correct, complete, or update your personal data.
- Erase your personal data where it is no longer required.
- Withdraw consent at any time (this will not affect processing already carried out).
- Grievance redressal — to have your concerns addressed by us.
- Nominate another individual to exercise your rights in the event of death or incapacity.
To exercise any of these rights, email us at info@emsconsulting.in. We will respond within the timelines required by applicable law.
7. Consent & its withdrawal
You provide consent when you submit a form on our site. You may withdraw consent at any time by contacting us; we will then stop processing your data for the relevant purpose and, where appropriate, delete it.
8. Children
Our services are intended for individuals who are 18 years or older. We do not knowingly collect personal data of children.
9. Grievance Officer
If you have any questions, concerns, or complaints about how your personal data is handled, please contact our Grievance Officer:
10. Changes to this policy
We may update this policy from time to time. The “last updated” date above reflects the latest revision. Material changes will be reflected on this page.
This policy is provided for transparency and is not legal advice. We recommend having it reviewed by a qualified legal professional to ensure full compliance with the DPDP Act, 2023 and any rules notified under it for your specific operations.
